ALJ Union's Lawsuit Against SSA Dismissed

The lawsuit filed by the Association of Administrative Law Judges (AALJ), a union representing Social Security's Administrative Law Judges (ALJs), against the Social Security Administration (SSA) was dismissed by a Federal District Court in Illinois on Feb. 26, 2014.

The suit alleged that a recent SSA Directive requiring "all ALJs to issue 500-700 legally sufficient decisions each year" would violate their member's right to "freedom from agency interference, and specifically, their right to decisional independence" under the Administrative Procedures Act (APA).

The Court dismissed the lawsuit, citing the AALJ would first have to exhaust its remedies under the Civil Service Reform Act (CSRA) before proceeding to federal court.
